Petition to the Government of Canada
Whereas:
• Canada recognizes the State of Palestine, yet its trade policy does not adequately distinguish between Israel and Palestine;
• The Vienna Convention on the Law of Treaties Article 53 voids all treaties that infringe on the core rights of states to be free from violations of their territorial integrity and self-determination;
• Canada recognizes that Israeli settlements in the West Bank violate the Fourth Geneva Convention;
• According to the ICJ's 2024 Advisory Opinion, Canada is obligated not to recognize or assist Israel’s unlawful presence in the Occupied Palestinian Territory and must distinguish, in its economic and trade relations, between Israel and the OPT;
• The Canada–Israel Free Trade Agreement extends preferential tariff treatment to goods originating in the West Bank and therefore risks providing trade benefits to goods produced in illegal Israeli settlements;
• Despite international pressure, Israel continues to expand settlements and assert control over Palestinian territory, conduct the International Court of Justice has found to violate the Palestinian people’s right to self-determination; and
• Israel is facing proceedings at the International Court of Justice concerning alleged violations of the Genocide Convention in Gaza.
We, the undersigned, residents of Canada, call upon the Minister of Foreign Affairs to 1. Terminate the Canada–Israel Free Trade Agreement in accordance with its termination provisions; and
2. Impose stronger sanctions prohibiting all economic activity between Canadians and illegal Israeli settlements. These measures should include prohibitions on i) the trade of goods with, ii) the financing of, iii) the exchange of services with, iv) the purchase of, or investment in, properties in settlements and outposts by legal persons in Canada or Canadian Nationals.
