Petition to the Minister of Immigration, Refugees and Citizenship
Whereas:
• The Immigration and Refugee Protection Act (IRPA) identifies fairness, efficiency, and system integrity as core objectives of Canada’s immigration system;
• Iranian nationals invited by Immigration, Refugees and Citizenship Canada (IRCC) to apply for permanent residence are disproportionately referred for comprehensive security screening;
• These referrals result in prolonged and indefinite delays, causing serious hardship, including employment and travel restrictions, expired Social Insurance Numbers, and difficulties maintaining legal status; and
• These systemic delays and the lack of transparency regarding the criteria used for referrals undermine public confidence in the fairness, efficiency, and accountability of Canada’s immigration system.
We, the undersigned, citizens and residents of Canada, call upon the Minister of Immigration, Refugees and Citizenship to commission an independent body to audit IRCC’s security referral practices, particularly as they apply to Iranian applicants, to ensure referrals are individualized, proportionate, and compliant with the Canadian Charter of Rights and Freedoms and the Canadian Human Rights Act.
1. Publicly disclose the criteria governing comprehensive security referrals;
2. Require IRCC officers to document the reasons for each referral, enabling oversight and access through the Access to Information Act;
3. Establish an internal review process, in coordination with partner agencies, for cases exceeding published processing times by more than 12 months, with priority given to applicants residing in Canada; and
4. Require all involved agencies to adopt binding service standards and communication protocols, and engage with the Iranian-Canadian community to develop rights-respecting solutions.
